Terms and conditions
Details of the Earnings Match Offer and instructions on how to participate will be communicated to users via email from Uber Carshare (“Instructions”). These Instructions, and the promotional offer itself, form part of these Terms and Conditions.
Offer is only available to individuals who attend a live webinar session and have not previously listed a car on the Uber Carshare (formerly Car Next Door) platform. The start and end date of the promotion are set out in the Instructions. Individuals must enter the promo code provided to them in the Instructions when listing their vehicle, during the promotion period. Offer not valid in conjunction with any other offer.
Where “Earnings Period” is mentioned in these Terms and Conditions, this refers to the earnings period as set out in the Instructions. This is the period in which we'll assess a vehicle's earnings, as well as its qualification against each of the offer eligibility criteria.
Eligibility criteria
To be eligible for the Earnings Match Offer, car owners must ensure their car meets certain eligibility criteria. If your car meets the eligibility criteria, we’ll match its Gross Income, earned during the Earnings Period, up to $1,000. Gross Income is your income after we take our commission but does not include your running costs.
To be eligible for the Earnings Match Offer, your car must:
- Be listed on Uber Carshare during the promotion period with the ‘How Car Sharing Works’ Webinar Earnings Match Offer promo code
- Be new to the Uber Carshare (formerly Car Next Door) platform
- Be registered, roadworthy and well-maintained, and meet Uber Carshare’s car eligibility criteria
- Be automatic and manufactured no earlier than 2007
- Use an Instant Keys kit, allowing members to pick up and return keys from an electronic lockbox. Instant Keys sharing plans start from $19 per month
Car owners must also comply with their obligations under the Owner Agreement section of the Member Agreement, act in good faith and not do anything that is intended to, or likely to have the effect of, reducing their vehicle’s bookings (for example, but not limited to, asking borrowers to cancel a booking or intentionally making it difficult for borrowers to access or enjoy the use of the car).
If your car is made unavailable due to damage caused by a borrower, Uber Carshare may, in its reasonable discretion, honour the incentive. You may also be entitled to compensation of $25 for each day your car is unavailable to you, to a maximum of 28 days (see here for more information).
Promotion entry and qualification
To submit a claim, individuals must, during the promotion period:
- if not already an approved member of Uber Carshare:
- visit the Uber Carshare website (“the Website”) or the Uber Carshare (formerly Car Next Door) app;
- follow the prompts to apply to become a member;
- complete a credit check and verification;
- when prompted, enter the specific Earnings Match Offer promo code.
- if already an approved member of Uber Carshare:
- visit the Uber Carshare website (“the Website”) or the Uber Carshare (formerly Car Next Door) app;
- when prompted, enter the specific Earnings Match Offer promo code.
To be eligible to receive the offer, individuals must:
- complete their application to share their car in accordance with clause 2 of the Member Agreement before the expiry of the promotion period;
- have their application accepted by the Promoter;
- ensure their car meets the all of the eligibility criteria outlined above;
- meet the Promoter’s car and member eligibility criteria;
All successful claimants will receive the applicable credit on their Uber Carshare member account. The credit will be applied on the last day of the Earnings Period and will appear in the following month's invoice. The credit will be set off against any sharing plan fees and any other amounts owing for that invoice period.
Individuals acknowledge and agree that when signing up, they may be offered a sharing plan that incurs a monthly membership fee. To be eligible for the Earnings Match, car owners must list their car with an Instant Keys sharing plan.
The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Maximum of one claim permitted per owner.
The Promoter’s decision is final and no correspondence will be entered into.
Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
