Terms and conditions

T&Cs in the email communications sent to participants on how to participate in this promotion, and the promotional offer itself, form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

Offer will be promoted to eligible users via email communications and/or phone calls from Uber Carshare and is limited to individuals who receive a promotional campaign directly to them specifying this offer.

Promotion period opens at 12.01 AM AEST on 1 September 2023 and closes at 11.59pm AEST on 30 November 2023.

Eligibility criteria

To qualify for the Plan Fee Reduction Offer, car owners must ensure their car meets certain eligibility criteria during a given calendar month of the Promotion Period. If your car meets the eligibility criteria for a full calendar month during the Promotion Period (defined as September, October and November 2023), we’ll credit your account with an applicable credit. 

The credit amount available to you is based on a car’s specific sharing plan, as outlined below. The Sharing Plan Fee Credit Offer is only available to cars on these sharing plans (“Eligible Cars").

To qualify for an applicable credit, your car must have, during a given calendar month of the Promotion Period:

  • Be registered, roadworthy and well maintained, and meet Uber Carshare’s car eligibility criteria 
  • Maintain compliance with Tasmania’s “Hire and Drive” requirements
  • Be listed in Tasmania
  • Get the regular safety and roadworthy inspections (send us the records as they fall due) 
  • Have the minimum driver age set to 21
  • Maintain at least 70% availability each calendar month
  • Be on an Instant Keys, Full-time Fleet or Legacy sharing plan
  • Be priced no higher than 25% above recommended hourly, daily and peak time rates, and have the distance rate set to:
    - 31c/km or lower for regular cars
    - 37c/km or lower for 4WD/SUV, Van/Ute 
  • Maintain an owner cancellation rate below 10%. This includes asking borrowers to cancel bookings
  • Have a monthly earnings of less than $500. That’s your share of your car’s time and distance income from bookings ending in the month.

Car owners must also ensure their vehicle remains registered, roadworthy and well maintained, and compliant with Uber Carshare’s car eligibility criteria. Car owners must also comply with their obligations under the Owner Agreement of the Member Agreement, act in good faith and not do anything that is intended to, or likely to have the effect of, reducing their vehicle’s bookings (for example, but not limited to, asking borrowers to cancel a booking or intentionally making it difficult for borrowers to access or enjoy the use of the car).

If your car is made unavailable or has a cancellation event directly resulting from an incident occurring during an Uber Carshare trip that renders the car unusable, Uber Carshare may, in its reasonable discretion, honour the incentive. 

Qualification will be assessed on the last business day of each calendar month. This assessment will consider the period between the first business day of each month and the last business day of each month, as outlined below.

All successful claimants will receive applicable credit on their Uber Carshare member account. The credit will be applied on the last business day of each Assessment Period in which the vehicle has qualified. 

Note: Owners will continue to see their monthly owner plan fees in their Account Summaries and invoices. Any applicable credit received will be set off against these plan fees and any other amounts owing for that invoice period.

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter’s decision is final and no correspondence will be entered into.

Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
