Earning match offer for new owners (Nov- Dec 23)

 

Eligibility Criteria: 

To be eligible for the Earnings Match Offer, car owners must ensure their car meets certain eligibility criteria. If your car meets the eligibility criteria, we’ll match its Gross Earnings, earned during the Earnings Period, up to $800. Gross Earnings is your earnings after we take our commission, before sharing plans fees and does not include your running costs.

 

To be eligible, your vehicle must:

  • Be fully electric
  • Be new to the Uber Carshare platform as of 27/11/23
  • Have a market value of less than $89k
  • Be on either the Instant Keys or Full-Time Fleet Sharing plan
  • Be available for a minimum 80% of hours for the month of December
  • Be registered, roadworthy and well-maintained, and meet the remainder of Uber Carshare’s car eligibility criteria (other than as stated here in these eligibility requirements).

Car owners must also comply with their obligations under the Owner Agreement section of the Member Agreement.

 

Terms and Conditions

Promotion opens on 28th November and ends on 31 December 2023 (“Promotion Period”). To be eligible, vehicles need to be newly listed to Uber Carshare within this period. Promotion offer is limited to 1 redemption of one eligible vehicle per user, for the first 100 users. Redemption of this promotion for vehicles with a market value above the regular car eligibility criteria but below $89,000 is limited to the first 40 vehicles. Your car must meet all of the requirements outlined in the full terms and conditions to be eligible for the Earnings Match offer. Promotion entry and qualification:

To submit a claim, individuals must, during the promotion period:

  1. Complete the promotion registration form
  2. Speak to an Onboarding representative over the phone to complete the vehicle listing

To be eligible to receive the offer, individuals must: 

  1. Speak with an onboarding agent and complete their application to share their car in accordance with clause 2 of the Member Agreement before the expiry of the promotion period; 
  2. have their application accepted by the Promoter; 
  3. ensure their car meets the all of the eligibility criteria outlined above; 
  4. meet the Promoter’s car eligibility criteria and member eligibility criteria

All successful claimants will receive the applicable earnings match on their Uber Carshare member account. The payment will be applied within 10 business days of the last day of the Earnings Period and will appear in the following month's invoice. The credit will be set off against any sharing plan fees and any other amounts owing for that invoice period.

Individuals acknowledge and agree that when signing up, they may be offered a sharing plan that incurs a monthly membership fee. To be eligible for the Earnings Match, car owners must list their car with an Instant Keys sharing plan. 

The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

Maximum of one claim permitted per owner. 

The Promoter’s decision is final and no correspondence will be entered into.

Rewards, or any unused portion of a reward, are not transferable or exchangeable, unless otherwise specified. 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
