Terms and conditions

  1. Instructions on how to claim the cash credit received under this promotion (“Credit”) are set out in the email or original communications to you about this promotion (“Instructions”) and form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer.
  2. Only one redemption is available per person.
  3. Redemption period starts 22 January 2024 and ends 29 February 2024 (“Redemption Period”).
  4. To be eligible individuals must, during the Redemption Period:
    (a) visit www.ubercarshare.com (“the Website”), the Uber Carshare (formerly Car Next Door) App or the ‘Carshare’ section of the Uber App;
    (b) make a booking which: i) starts before the end of the Redemption Period, and ii) is at least 1 day (24 hours) in duration;
    (c) complete (i.e. not cancel) their booking
  5. All successful claimants will receive Credit on their Uber Carshare member account to the Credit amount after completing their trip. The Credit will be applied in accordance with the Member Agreement, available at: https://www.ubercarshare.com/terms-of-use
  6. Your Credit will be added to your available balance in your member account. You can use these funds towards your next booking, or withdraw them back to your card.   7. Uber Carshare Pty Ltd (“Promoter”) reserves the right, at any time, to verify the validity of claims and a claimant’s details (including a claimant’s identity, age and place of residence) and reserves the right to disqualify any individual who the Promoter reasonably believes has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct in connection with the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  8. The Promoter’s decision, acting reasonably, as to the claimant’s eligibility is final and no correspondence will be entered into.
  9. Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  10. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention, or fraud, the Promoter reserves the right, acting reasonably and to the fullest extent permitted by law, to (a) disqualify any claimant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate.
  11. The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.
  12. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, or any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”).
  13. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not liable for any claim, loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward, except to the extent that any such claim, loss, or damage has been caused or contributed to by the Promotor’s fraud, negligence or wilful misconduct.
  14. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, available at: https://www.ubercarshare.com/terms-of-use/privacy-policy. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
  15. All entries become the property of the Promoter.
  16. The Promoter is Uber Carshare Pty Ltd of Level 30, 580 George St, Sydney NSW 2000 ABN 11 609 590 463.
