Terms and conditions

T&Cs in the email communications sent to participants on how to claim and the reward(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

Offer will be promoted to eligible users via email communications and/or phone calls from Uber Carshare and is limited to individuals who receive a promotional campaign, via email and/or phone calls, directly to them specifying this offer. Promo codes are unique to the email recipients and are not transferable. Offer not valid in conjunction with any other offer.

Users must enter the unique promo code provided to them via email only when listing their vehicles, before the Promotion Period end date. Offer not valid in conjunction with any other offer.
Maximum number of vehicles permitted per person included in the email communications from Uber Carshare.

The promotion starts at 00.01 am AEST on 31 January 2024 and closes at 11.59 pm AEST on 30 April 2024 (“Promotion Period”)

Vehicles must be listed and available for borrowers to book between the Promotion Period start date and 29 February 2024 to be considered eligible for this promotion.
Assessment Period starts at 00.01 am AEST on 1 March 2024 and ends at 11.59 pm AEST on 30 April 2024.

 

Eligibility criteria

To be eligible for the Earnings Match Offer, car owners must list and make their cars available for bookings before 29 February 2024 using the unique promo code provided to them via email only and ensure that the vehicle meets the Eligibility Criteria set out below. If your car meets the Eligibility Criteria, we’ll match its Gross Income earned during the Assessment Period, 1 March 2024 to 30 April 2024, up to $1,200. Gross Income is your income after we take our commission but does not include your running costs.

To be eligible for the Earnings Match Offer, your car must meet the following (“Eligibility Criteria”):

  • Be listed on Uber Carshare from the Promotion Period start date to 29 February 2024. 
  • Be new to the Uber Carshare (formerly Car Next Door) platform.
  • Be registered, roadworthy and well-maintained, and meet Uber Carshare’s car eligibility criteria.
  • Be automatic and manufactured no earlier than 2010.
  • Use an Instant Keys kit, allowing members to pick up and return keys from an electronic lockbox. 
  • Maintain an owner cancellation rate below 10% for the Assessment Period. This includes asking borrowers to cancel bookings.
  • Maintain a minimum of 80%  (in the homezone, with the lockbox and key accessible) availability during the Assessment period.

Car owners must also comply with their obligations under the Owner Agreement of the Member Agreement, act in good faith and not do anything that is intended to, or likely to have the effect of, reducing their vehicle’s bookings (for example, but not limited to, asking borrowers to cancel a booking or intentionally making it difficult for borrowers to access or enjoy the use of the car).

If your car is made unavailable due to damage caused by a borrower, you won’t be entitled to any lost income compensation related to this promotion during the Assessment Period, however, you may be entitled to compensation of $25 for each day your car is unavailable to you, to a maximum of 28 days (see here for more information). 

Promotion entry and qualification

To submit a claim, individuals must:

  1. register for the promotion by clicking the sign-up link included in the email, push message or SMS communication from Uber Carshare and use the unique promo code provided in the email before 29 February 2024; 
  2. visit the Uber Carshare website (“the Website”) or the Uber Carshare (formerly Car Next Door) app; and
  3. follow the prompts to list a car before the end of the Promotion Period.

To be eligible to receive the Earnings Match, individuals must: 

  1. complete their application to share their car in accordance with clause 2 of the Member Agreement before the expiry of the Promotion Period; 
  2. have their application accepted by the Promoter; 
  3. ensure their car meets all of the Eligibility Criteria outlined above; and
  4. meet the Promoter’s car eligibility criteria and member eligibility criteria

All successful claimants will receive the applicable credit on their Uber Carshare member account. The credit will be applied within 10 days after the Promotion Period ends, specifically on 10 May 2024, after your car has been available on the Uber Carshare platform for the Promotion Period.
The credit will be set off against any sharing plan fee and any other amounts owing for that invoice period.

Individuals acknowledge and agree that when signing up, they may be offered a sharing plan that incurs a monthly membership fee. 

The Promoter reserves the right to disqualify any individual who the Promoter reasonably  believes has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter’s decision, acting reasonably, is final and no correspondence will be entered into.

Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, acting reasonably and to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not liable for any claim, loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a claimant; or (e) use of a reward, except to the extent that any such claim, loss, or damage has been caused or contributed to by the Promotor’s fraud, negligence or wilful misconduct.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
