Terms and conditions

T&Cs in the email communications sent to participants on how to claim and the reward(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

Offer will be promoted to eligible users via email communications and/or phone calls from Uber Carshare and is limited to individuals who receive a promotional campaign, via email and/or phone call, directly to them specifying this offer. Offer not valid in conjunction with any other offer.

Upgrade your car to Instant Keys before the end of 2024. Promotion starts on the date stated in the email communications from Uber Carshare and ends on 31 December 2024 .

Assessment Period is the following 3 months after you upgrade to Instant Keys.

Eligibility is assessed per each calendar month after you have upgraded. See examples below.

Bonus amount

If owner upgrades membership from Key Handover to Instant Keys and their car has met the below Eligibility Criteria for the following 3 months after the upgrade, owner will will receive (see example assessment and payment periods below): 

  • At the end of the first month following the upgrade to Instant keys: $29 (start up fee) + $19 membership fee.
  • At the end of the second month following the upgrade to Instant Keys:another $19. 
  • At the end of the third month following the upgrade to Instant keys: another $19. 

Eligibility Criteria

To be eligible for the bonus, car owners must upgrade their Key Hanover car to any Instant Keys membership and make their car available for bookings before the expiry of the Promotion Period and ensure that the vehicle meets the monthly Eligibility Criteria set out below. If your vehicle meets all of the following requirements, you’ll get the monthly bonus earnings.

Maximum 1 vehicle permitted per person for this promotion.

To be eligible for the bonus, your car must meet the following criteria for each calendar month:

  • Be registered, roadworthy, well maintained, and meet the remainder of Uber Carshare’s car eligibility criteria (that is, other than as stated in these eligibility requirements), as set out in the Member Agreement.
  • Maintain at least 70% availability. This means it must be available for borrowers to book for at least 70% of the total hours in each Assessment Period inclusive.
  • Be on an Instant Keys or Full-Time Fleet sharing plan.
  • Maintain an owner cancellation rate below 10%. This includes asking borrowers to cancel bookings.
  • Be made available (in the homezone, with the lockbox and key accessible) for every booking. 

Car owners must also comply with their obligations under the Owner Agreement of the Member Agreement, act in good faith and not do anything that is intended to, or likely to have the effect of, reducing their vehicle’s bookings (for example, but not limited to, asking borrowers to cancel a booking or intentionally making it difficult for borrowers to access or enjoy the use of the car).

If your car is made unavailable due to damage caused by a borrower, Uber Carshare may, in its reasonable discretion, honour the bonus earnings, however it is under no obligation to do so. Subject to the Member Agreement,  you may also be entitled to compensation of $25 for each day your car is unavailable to you, to a maximum of 28 days.

All successful claimants will receive applicable credit on their Uber Carshare member account. 

The credit will be applied within 2 days after each monthly assessment period as specified above. 

The credit will be set off against any sharing plan fee and any other amounts you owe Uber Carshare for that invoice period.

Individuals acknowledge and agree that when listing a car, they may be offered a sharing plan that incurs a monthly membership fee. To be eligible for the bonus, members must list their car with an Instant Keys or Full-Time Fleet sharing plan. 

The Promoter reserves the right to disqualify any individual who the Promoter reasonably believes has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated in connection with  the promotion. Errors and omissions may be accepted at the Promoter's reasonable discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

The Promoter’s decision, acting reasonably, as to the claimant’s eligibility is final and no correspondence will be entered into.

Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, acting reasonably and to the fullest extent permitted by law to (a) disqualify any claimant; or (b) modify, suspend, terminate or cancel the promotion, as appropriate.

The use of any automated software or any other mechanical or electronic means that allows a claimant to automatically claim repeatedly is prohibited and will render all claims submitted by that claimant invalid.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). 

Except for any liability that cannot be excluded by law, including for the Non-Excludable Guarantees, the Promoter, including any of its officers, employees or agents, is not liable for any claim, loss or damage of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or in connection with this promotion, save to the extent that such claim, loss or damage arises from the fraud, negligence or wilful misconduct of the Promoter, or any of its officers, employees or agents.

The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, UBER Australia Limited and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter uses and handles PI in accordance with its Privacy Policy. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
